Terms and Conditions for the Kochblume Advent Calendar 2024

I. Terms and Conditions

1. Organizer

(1) The organizer of the competition is:

(hereinafter "Kochblume").

(2) The operational execution is carried out by
motif. film, Mittelstraße 42, 68169 Mannheim
(hereinafter "motif.").
However, data processing is the responsibility of Kochblume.

(3) By participating in the competition, participants accept these terms and conditions as well as the privacy policy.

2. Prize

(1) In the Kochblume Advent Calendar 2024, a daily prize will be raffled off every day from December 1st to December 24th, 2024. The respective prize will be announced in the corresponding daily post on Instagram or Facebook.

(2) Cash payment or exchange of prizes is excluded.

(3) The claim to a prize is non-transferable.

3. Eligibility

(1) Participants must be at least 18 years old.

(2) Only persons with a residence in Germany are eligible to participate.

(3) Employees of Kochblume and motif. as well as their relatives are excluded from participation.

(4) Kochblume reserves the right to exclude participants who violate these terms and conditions, manipulate, or publish illegal content or content that violates platform guidelines.

(5) Participants are responsible for providing correct and complete information.

4. Participation in the Competition

(1) Participation is possible via Instagram and Facebook.
To participate in the respective daily prize draw, participants must:

  • follow the official Kochblume Instagram or Facebook channel,

  • like the respective Advent Calendar post,

  • tag a person in the comment.

(2) Bonus entry:
An additional chance to win exists if the respective daily post is shared in the

  • Instagram story or

  • Facebook story
    is shared (if technically possible).

(3) Each daily draw runs from 00:00 to 23:59 on the respective calendar day.

(4) Participation by any other means is excluded.

(5) The recorded time of the respective platform is decisive.

(6) Kochblume accepts no liability for technical malfunctions or platform failures.

5. Winner Determination and Processing

(1) The winners of the respective daily competition will be determined on the following day by motif. on behalf of Kochblume using a random principle.
Example: Competition from Dec 1 → Draw on Dec 2

(2) Notification will be sent via Direct Message (DM) on the platform where the participation took place.

(3) Winners must confirm their prize within 6 working days via DM and provide their shipping address.

(4) If no response is received within this period, the prize will be forfeited and a new person will be drawn.

6. Rights of Use

Since participation is exclusively via likes and comments, no user-generated content is submitted.
Therefore, no further rights of use are transferred.

7. Early Termination

Kochblume reserves the right to cancel or adjust the competition or parts of the Advent Calendar without prior notice due to unforeseen circumstances, if proper execution cannot be guaranteed.

8. Liability

Kochblume is liable within the framework of legal provisions.
Liability for technical failures, data loss, or platform disruptions is excluded.

9. Legal Recourse

Legal recourse is excluded.
The law of the Federal Republic of Germany applies.

II. Data Protection Regulations

1. Controller and Purpose

(1) Responsible for the processing of personal data within the framework of the competition is:

(2) Processed data:

  • Instagram or Facebook username

  • If won: first and last name, shipping address

(3) The purpose of data processing is exclusively the execution and handling of the competition.
Legal basis: Art. 6 para. 1 lit. a GDPR (Consent).

(4) The data will be deleted at the latest two weeks after the completion of the Advent Calendar, unless there are legal retention obligations.

2. Data Transfer

(1) Access to the data is exclusively granted to Kochblume and motif. as contracted service providers.

(2) Data will only be passed on to third parties if this is necessary for sending the prizes (e.g., shipping service providers).

3. Withdrawal of Consent

Consent can be withdrawn at any time with effect for the future:
service@kochblume.de

A withdrawal before the prize is sent leads to exclusion from the draw.

4. Rights of Participants

According to the GDPR, the following rights exist:

  • Information about processed personal data (Art. 15)

  • Rectification of incorrect data (Art. 16)

  • Erasure (Art. 17)

  • Restriction of processing (Art. 18)

  • Data portability (Art. 20)

5. Right to Lodge a Complaint

There is a right to lodge a complaint with the competent data protection supervisory authority of the federal state in which the participants reside.
